Faegre Drinker Team Secures Favorable 11th Circuit Ruling for Sentry in LTCi Case

On May 13, 2025, a Faegre Drinker insurance team including Sandra Jones and Franziska Mangot secured a favorable opinion from the 11th Circuit for client Sentry Insurance. The 11th Circuit affirmed the lower court’s decision on summary judgement, ruling in favor of Sentry regarding a long-term care insurance (LTCi) “provider eligibility” dispute in Florida.

The opinion upheld the lower court’s finding that the policy at issue would reimburse plaintiffs for “Medically Prescribed Care,” and the insureds’ residence in a Florida-licensed Assisted Living Facility was not “Medically Prescribed” as required. The decision is significant in the LTCi industry, as provider eligibility disputes remain at the forefront of issues facing insurers.
