Lynne Anderson Quoted in Law360 About Rodriguez v. Raymours

Labor & Employment partner Lynne Anderson was quoted in a Law360 article titled, “The Biggest New Jersey Cases of 2016.” The article is a year-end summary of the five most notable opinions in 2016 for New Jersey law.

Lynne provided commentary on Sergio Rodriguez v. Raymours Furniture Co. Inc. The opinion invalidated the six-month time limit in Raymours’ arbitration agreement to file New Jersey Law Against Discrimination (LAD) claims. Lynne pointed out that the court was “very clear” that the basis for overturning the private agreement to limit the 2 year statute of limitations period for LAD claims was protection of the public interest in preventing and eradicating discrimination. “Should the Rodriquez v. Raymours decision be interpreted to void agreements to limit other statutes of limitations, such as for contract or tort claims? The answer should be no, as the court’s opinion was limited to the enforceability of the LAD waiver,” Lynne said.
