Zimmer Team Wins First Bellwether Trial Defending NexGen Flex Knee Implants

Faegre Baker Daniels represented Zimmer in securing its first multidistrict litigation victory in defense of the company’s NexGen Flex knee implants.

After a nearly four-week trial, a federal jury in Chicago rejected claims Friday, Nov. 6, that Zimmer’s design was negligent and that the company failed to warn the surgeon performing the bellwether plaintiff’s double knee replacement. This verdict is especially noteworthy because it was a “bellwether” trial that the plaintiffs hand-picked as the first case tried.

FaegreBD Partners Jim O’Neal, Andrea Roberts Pierson, Peter Meyer and Paralegal Nicole Brett represented Zimmer in court, supported by a cross-office team of attorneys and staff.

FaegreBD has also tried and won three jury verdicts involving Zimmer’s hip replacement product in the last year.
