Cirrus Design Invalidates All Asserted Claims and Achieves Affirmance by Federal Circuit

Cirrus Design engineered a whole-aircraft ballistic parachute technology that has saved hundreds of lives. When Cirrus’s technology was accused of patent infringement by Hoyt Fleming, Faegre Drinker mounted a strong defense including a declaratory judgement action in the District of Minnesota and two petitions for inter partes review. Ultimately, all asserted claims of the patent-in-suit were found unpatentable, including in a precedential decision by the Federal Circuit.
