Companies Receive Guidance on MMSEA Section 111 Reporting Requirements for Employment Action Settlements

North America - United States

Under Section 111 of the Medicare, Medicaid and SCHIP Extension Act of 2007 (MMSEA), there are certain situations where a settlement arising out of an employment action might be reportable to the Centers for Medicare and Medicaid Services (CMS) based on the nature of the settlement agreement.

Our firm works with employers and insurance companies to assess the extent to which employment liability and other similar claims must be reported to CMS pursuant to the Section 111 requirements. We counsel employers and insurance companies on how to register with CMS as a Responsible Reporting Entity (RRE) and how to proceed through the Section 111 reporting process in the event of reportable employment liability claims.
