Hana Amicus on Trademark Tacking

The American Intellectual Property Law Association (AIPLA) filed an amicus brief to the U.S. Supreme Court on the issues at stake in Hana Financial, Inc. v. Hana Bank et al. Our firm represented AIPLA in the amicus brief filing.

The concept of trademark tacking—whether the time period covering the use of similar but not identical trademarks can be linked together for purposes of determining the first use date of a particular trademark—was at issue in this case. The brief argued that a jury, made up of consumers, is the best judge of whether the relevant facts support a finding of trademark tacking.
