Shaunda Patterson-Strachan, Dawn Williams and Laura Wall Contribute ABA Tort Trial and Insurance Practice Section Book Chapters

Insurance partners Shaunda Patterson-Strachan and Dawn Williams and associate Laura Wall coauthored and coedited the District of Columbia and D.C. Circuit chapters in the American Bar Association’s (ABA) Tort Trial and Insurance Practice’s third edition of “Misrepresentation in the Life, Health, and Disability Insurance Application Process.”

The publication provides life, health and disability insurance practitioners with a national survey of all 50 states, D.C. and the federal circuits about misrepresentations in applications as well as the applicable case law interpreting relevant statutes. It also addresses issues related to misrepresentations in the context of the Employee Retirement Income Security Act (ERISA).

The book further covers issues in the application process, including what constitutes misrepresentation, how policies are appropriately rescinded and defenses that may be raised to contest a decision to rescind a policy.
