Toxic Tort Litigation

Overview

When claims of exposure to environmental contaminants, pesticide products, chemicals, alleged pollution, or hazardous waste lead to investigations or litigation, we defend companies and help you navigate the Toxic Substances Control Act (TSCA), Resource Conservation and Recovery Act (RCRA), Superfund liabilities, and workplace evaluation and testing. We can represent you in criminal and civil proceedings brought by state and federal enforcement agencies under the Clean Air Act, Clean Water Act, RCRA, and the Community Right to Know Act. And we defend wrongful death and personal injury litigation arising from alleged chemical product or fume exposure. Our relationships with leaders in medicine, toxicology, epidemiology, occupational health, remediation, and industrial hygiene support a science-based defense to persuade judges and juries. During allegations of chemical migration onto land or into groundwater or drinking water, we defend property damage claims and any real estate or chancery court issues that might arise.
