Major Colorado Health System Defeats Class Certification

A major Colorado health system faced a class action alleging it inadequately disclosed emergency room chargemaster prices. The class action also sought to require the health system to initiate individual quantum meruit suits whenever a patient disputed the reasonableness of a charge. Faegre Drinker represented the health system in the matter and following discovery, briefing and argument, the state court denied the plaintiffs’ class certification motion, after which the class representative dismissed the entire case.
