Restaurant Franchisor Wins Total Victory Against Holdover Franchisee

A restaurant franchisor filed a lawsuit in South Dakota federal court against a terminated franchisee who continued using the franchisor’s trademarks and violated the non-compete after termination. Our firm represented the franchisor in this lawsuit.

The court granted the franchisor’s requests for preliminary and permanent injunctions, default judgment, contempt sanctions, and an award of Lanham Act treble damages and attorneys' fees.
