Insurance Provider Wins Dismissal of Common Law and Statutory Bad Faith Claims

After a Colorado Supreme Court decision disallowed the offset of workers’ compensation benefits against payments for uninsured motorist benefits, the client, a national insurance provider, was sued in a putative class action case alleging common law and statutory bad faith claims. In the course of discovery, our firm worked with the client to develop and apply search terms to identify potential class members. That work revealed that the class lacked numerosity, and our firm used that information to negotiate a stipulated dismissal of all class claims.
