Government and regulatory affairs associate Matthew Kinsman spoke with The Indiana Lawyer to discuss the recent US Supreme Court ruling that struck down President Trump’s use of the International Emergency Economic Powers Act to impose tariffs on national importers.
When asked about the current tariff landscape, Kinsman stated, “We just haven’t seen anything on this scale before.”
Following the Court’s ruling, the Trump administration imposed a broad 10% surcharge on imports under Section 122 of the Trade Act, which can last up to 150 days unless Congress approves an extension.
“I think the ability of the administration to get [congressional approval] would pose some challenges,” Kinsman shared.
