Education partner John Przypyszny commented on the Department of Education’s move toward stricter compliance standards for institutional accreditors in The Chronicle of Higher Education.
The article discussed the Department of Education’s recent notices to two accreditors that stated the organizations would not be fully compliant until they permanently remove all diversity, equity, and inclusion (DEI) language from their standards.
The department cited the Supreme Court’s 2023 decision eliminating the use of race in admissions, saying it should be interpreted to prohibit colleges from considering race in any other aspect of campus operations.
Przypyszny explained that the department is taking an expansive view of the Court’s ruling, which “only talked about preferences based on race in admissions.” He further noted that the Court’s decision did not say it’s legally prohibited for a university to have a policy on diversity or support DEI in its mission.
