What ‘Navigable Waters’ Definition Means for Indiana Agriculture

Environment and energy associate Amy Waite authored an article for the Indianapolis Business Journal discussing “navigable waters” as defined by the Clean Water Act, which provides the United States Environmental Protection Agency (EPA) with federal jurisdiction over the term.

Waite explains that the scope of federal jurisdiction under the Clean Water Act has been a challenge for farms, ranches and other agribusinesses, and she outlines rulemakings that have altered the definition of Waters of the United States (WOTUS).

The author provides an overview of the 2023 rule, which codifies two long-standing exclusions from the WOTUS definition, and outlines six new WOTUS exclusions relevant to agriculture.
