Remote Participation in Virtual Depositions, Hearings, Oral Arguments and Trial

Litigation partner Oderah Nwaeze authored an article for LexisNexis on best practices for attorneys to consider when planning for virtual litigation, including depositions, hearings, oral arguments and trials.

Due to the COVID-19 pandemic, Nwaeze explained how litigation has become even more challenging as proceedings have been moved from in person to virtual. Thus, “litigating through videoconferencing platforms requires a significant amount of planning and intentionality to replicate the effectiveness of in-person appearances.”

Nwaeze further detailed the efforts necessary to be successful in a virtual proceeding. For example, he described technological and logistical considerations for virtual depositions, such as how to use and deploy exhibits and the importance of practicing the deposition with colleagues ahead of time. Nwaeze also highlighted tips for virtual appearances, including what to wear and how to set up the video call.

Additionally, Nwaeze emphasized abiding by court rules and guidelines for virtual proceedings and discussed how to prepare for a trial or hearing. Lastly, he shared tips for attorneys regarding when to sit or stand while making arguments or questioning witnesses in a virtual setting.
