Dallas Business Litigation counsel David Kent authored an article for the American Bar Association’s Section of Litigation Trial Evidence Newsletter titled “Will COVID-19 Make ‘Unavailable’ Witnesses Available?”

Kent writes that as pandemic emergency orders begin to expire, courts will need to turn to preexisting rules or amendments of those rules for authority to continue to use the remote witness testimony.
