Justin Kay was quoted in Legaltechnews for a story regarding retailers tracing consumers movements in stores in an effort to ascertain their buying habits. In the article, Justin explained that traditional consumer protection statutes could apply to the collection of consumers’ movements if the collection is a “deceptive practice” under federal or state consumer protection authorities: if a company announced it was not collecting precise geolocation, but it actually was, the collection could violate the FTC Act, the Children’s Online Privacy Protection Act (COPPA) Rule, or state law.
