Better Information Governance Means Better E-Discovery Outcomes—Part I: E-Discovery in the Big Data Era
Washington, D.C., associates Yodi Hailemariam and Amy Ramsey Marcos co-authored the first article in a three-part series in Corporate Counsel titled “Better Information Governance Means Better E-Discovery Outcomes—Part I: E-Discovery in the Big Data Era.”
Yodi and Amy advocate for lawyers to understand the link between how an organization governs its information and how well and quickly that organization can move through the stages of e-discovery. They discuss a number of issues concerning the e-discovery landscape in the big data era, proportionality principles in light of the 2015 amendments to the Federal Rules of Civil Procedure (FRCP), and core principles of information governance.
Part II of the series will examine how information governance practices can affect e-discovery, with an emphasis on the amendment to FRCP 37(e), and discuss recent case law in this area. The third part of the series will walk through practical approaches to creating a solid governance framework within a company and include several initial IG-centered projects that benefit e-discovery and litigation as a whole.
