Kate Deal, Meredith Slawe, and Justin Kay Publish Biometrics Article in Law360

A client alert by Kate Deal, Meredith Slawe and Justin Kay has been republished as an article titled “Illinois Biometrics Legislation Sets Trend” in Law360.

The article examines how companies across industries are turning to biometric information to verify transactions, enhance corporate security, and market their business. Legislators in several states started the New Year by proposing laws to regulate the collection, use, and storage of such information.

The authors note that, if passed, the proposed legislation would not only impose significant notice, consent, and retention requirements on entities that obtain or use biometric data, but also could fuel the growth of class action lawsuits threatening uncapped statutory damages that started with enactment of the Illinois Biometric Information Privacy Act in 2008.
