New Qualifying Period for Unfair Dismissal

The qualifying period for unfair dismissal claims will rise on 6 April 2012 from one to two years. This will be welcome news for employers, although it is important to note that the increase only applies to those employees who start employment on or after 6 April 2012.    

Employees who started work before 6 April 2012 will be subject to the old one year qualifying period until they leave.  Also remember that there is no qualifying period for the vast majority of UK statutory claims, for example, discrimination and whistle blowing claims.  On balance, however, this is good news for companies and is one of the government initiatives designed to improve business confidence and boost economic growth.
