The Junk Fax Prevention Act of 2005 was signed into law by the President on July 9, 2005. Companies that communicate via fax should consider the effect of this legislation on their fax communications, including business-to-business faxes. The law preserves the ability of businesses to send unsolicited fax communications where they have an established business relationship with the fax recipient. The law amends existing provisions of the federal Communications Act. Although the law maintains a version of the previous established business relationship exception, the new law imposes additional requirements, such as mandatory opt-out language and required disclosures from the sender of unsolicited faxes.
