The Latest Stark Law Developments: New Theories, New Risks, New Issues

Washington, D.C., partner Jesse Witten participated in a HCCA webinar titled, “The Latest Stark Law Developments: New Theories, New Risks, New Issues,” on Wednesday, August 27.

Jesse reviewed recent Stark Law cases and settlements.  He discussed a recent novel case in which a clinical laboratory won a jury verdict in an unfair competition action against a competitor that offered free testing cups to physicians in alleged violation of the Stark Law.  He also explained how a number of defendants have been found liable for Stark Law violations even though they sought and relied upon legal advice.
