State Authorization of Distance Education: The Good, the Bad, and the Ugly

Overview

Washington, D.C., partner Jonathan Tarnow spoke at the 2015 Annual Conference of the National Association of College and University Attorneys (NACUA), held in Washington, D.C., on June 28.

Jonathan’s panel, titled, “State Authorization of Distance Education: The Good, the Bad, and the Ugly,” focused on the legal complexities of state regulation of cross-border online education and recent regulatory efforts by the U.S. Department of Education to require that online institutions be authorized in any state in which they enroll students.

The panel also discussed issues that postsecondary institutions should proactively address when entering into contractual agreements with third parties providing services related to their delivery of distance education courses and programs.
