Litigation Holds - The Preservation Duty & Related Privilege Concerns

Overview

William A. Wright participated in this presentation, relevant to litigators and transactional lawyers alike, which included a discussion of the salient legal principles governing litigation holds and an analysis of when the preservation duty arises and the scope of the resulting hold. It also reviewed recent case law examining the overlap between the work product doctrine’s “in anticipation of litigation” standard and the requirement that a litigation hold be implemented when a party “reasonably anticipates” litigation.
