Navigating Potential Products Liability Risks When Engaging in Advertising and Other Forms of Communication

Overview

Philadelphia partner Ken Murphy will speak at an upcoming American Conference Institute event “Products Liability Boot Camp for Life Sciences.” The event will feature a faculty of products liability defense lawyers sharing their insights on how particular actions and strategies can help overcome litigation risks facing the industry. Ken, vice-chair of the Products Liability and Mass Tort Practice Group, will co-present on the topic of “Navigating Potential Products Liability Risks When Engaging in Advertising and Other Forms of Communication.” The presentation will include insights into: explaining plaintiff theories based on over-promotion and negligent marketing; assessing how off-label issues can arise in products liability litigation; measuring the level of risks for different types of product claims by manufacturers; and determining what information to disseminate and what to withhold in light of its potential use against you.
