The Art of Settling TCPA Lawsuits

Overview

Chicago partner Justin O. Kay discussed “The Art of Settling TCPA Lawsuits” in a webinar co-hosted with Berkeley Research Group (BRG). Justin was joined by Peggy Daley and David Kalat, both of BRG.

Panelists explored strategic and practical considerations for resolving Telephone Consumer Protection Act (TCPA) lawsuits. Topics included (i) key considerations when deciding whether and when to settle; (ii) pointers for leveraging facts and legal theories to drive litigation towards resolution and drive down the costs of resolution; (iii) the advantages and disadvantages of class, partial class, and individual settlements; and (iv) tips for minimizing the risk that a court refuses to approve a class settlement.
