The Recent Wave of Biometric Information Privacy Litigation and Legislation

Litigation partner Justin Kay hosted a roundtable luncheon and interactive workshop on “The Recent Wave of Biometric Information Privacy Litigation and Legislation” at Drinker Biddle’s Chicago office on October 24, 2017 for the Chicago Chapter of the Association of Corporate Counsel. The discussion focused on the history of the Illinois Biometric Information Privacy Act (BIPA) and biometric privacy legislative efforts in other states, the various theories of liability under BIPA and potential defenses, and the recent spate of BIPA complaints challenging employers’ use of finger-scanning time clocks.
