Justin Kay Discusses Biometric Data on "Chicago Tonight"

Chicago partner Justin Kay appeared on WTTW’s “Chicago Tonight” on January 22, 2018 for a live, on-air discussion regarding biometric data and Illinois’ Biometric Information Privacy Act (BIPA), the first state law in the United States to comprehensively regulate biometric data.

Justin outlined the basics of BIPA and biometrics generally, discussed its increasing usage, outlined potential benefits (such as convenience) and risks (such as theft of the data), and stressed the importance of awareness of the law.  He also highlighted the spate of recent class actions filed against companies such as Facebook, Shutterfly, and Google based on alleged violations of BIPA.
