Philadelphia partner David Woolf was quoted in a Law360 article titled, “4 Things Employers Should Know About 'Comp Time' Bill.” House lawmakers recently passed the Working Families Flexibility Act, legislation amending the Fair Labor Standards Act to allow private-sector employers to offer employees the choice between being paid in cash for overtime, or accruing paid time off. The article discussed what the bill would mean for employers and their operations.

David noted that the bill could potentially benefit both employers and workers, but also highlighted that one potential pitfall for employers will be resisting the temptation to incentivize employees to take comp time during periods of the year when businesses aren't as busy, saying that could lead to potential lawsuits from employees.
