Prime Healthcare Fires Double-Barreled Response to DOJ Fraud Suit

Washington, D.C. partner Jesse Witten was quoted in BNA Bloomberg’s Health Law Reporter on September 6, 2016. In the article, Jesse discussed Prime Healthcare’s response to a Department of Justice (DOJ) fraud lawsuit, which stems from a separate whistle-blower False Claims Act suit against the healthcare organization.

Specifically, he commented on the use of statistical sampling in Medicare fraud cases, noting that “some courts may be willing to allow statistical sampling in health care cases,” but that “in many instances, the cases are not suited for statistical sampling” because of the variations among the claims submitted to Medicare.
