Barry Gross Quoted in The Philadelphia Inquirer

Philadelphia partner Barry Gross was quoted in a Philadelphia Inquirer article, titled, “Most with political ties escape testifying in Traffic Court case.” The article discussed the grant of immunity given to City Councilman Kenyatta Johnson, along with four Democratic ward leaders, in exchange for their testimony against five former Philadelphia Traffic Court judges on trial for an alleged ticket-fixing stint.

However, nearly all of those potential witnesses with ties to city politics never took the stand.

Barry, a partner in the White Collar Crime and Corporate Investigations Practice Group, represents Councilman Johnson.

“The government informed us that they were planning on calling Mr. Johnson. Then they told us about two weeks ago they weren’t going to,” said Barry. “It is hardly unusual for prosecutors to end up calling only a portion of the people they list as potential witnesses. Government lawyers might decide mid-trial to skip over someone they had intended to call as a means of speeding up a case or to avoid repetitive testimony.”
