Johnson & Johnson, Ethicon and Mentor Worldwide faced claims from an Ohio-based plaintiff claiming she developed anaplastic large-cell lymphoma as a result of using MemoryGel SILTEX Round Moderate implants. Our firm obtained a full, pre-answer dismissal in the product liability litigation.
The plaintiff brought claims for fraudulent misrepresentation, fraudulent concealment, consumer protection, design and manufacturing defects under the Ohio Products Liability Act, and breach of express warranty. All of the claims were dismissed with prejudice and a motion for reconsideration was denied.
