In an article for BenefitsPRO, benefits and executive compensation partner Brad Campbell offered insights on the Workers' Retirement Savings Protection Act of 2026, legislation that would require retirement investment advice, including guidance on 401(k)s, IRAs, and rollovers, to be provided in workers' best interests.
Campbell explained that the bill is a “legislative response to the federal courts consistently striking down the DOL expanded fiduciary advice regulations from 2016 and 2024." He added, "It would change the definition of ERISA fiduciary investment advice to include any individualized recommendation, including one-time sales recommendations, negating the 1975 five-part test established by the original (and again current) DOL regulation."
