Brad Campbell Discusses 401(k) Litigation With Wall Street Journal
Benefits and executive compensation partner Brad Campbell, who previously served as head of the Employee Benefits Security Administration, spoke with the Wall Street Journal about the Trump administration’s push to allow alternative 401(k) investments despite the threat of litigation.
The article noted that the Department of Labor has been more supportive of employers offering private 401(k) investments. For example, the Department rescinded a Biden-era regulation that cautioned small companies against offering private equity in 401(k)s. This summer, the Department filed an amicus brief supporting an employer that had used private investments for employee plans.
“We’re starting to see the DOL become more active in defending companies,” Campbell added.
