Dan Prokott Speaks to Minneapolis/St. Paul Business Journal About Minnesota Non-Compete Ban

Minneapolis/St. Paul Business Journal (MSPBJ) turned to labor and employment partner Dan Prokott for insight on Minnesota becoming the fourth state to impose a complete ban on post-employment non-competes, in addition to California, North Dakota and Oklahoma.

“The challenge for employers is, without the ability to just prevent someone from going to work for a competitor…the former employer may not know if that individual…is utilizing confidential information,” Prokott said.

Prokott further noted that action could still be taken against people misusing confidential information, adding, “The benefit of a non-compete agreement is we don’t have to worry about the possibility of that former employee doing harm in that way.”
