Autonomous Vehicle Product Liability Cases: The Road Ahead

Business litigation partner Elsa Bullard and product liability and mass torts associate Tess Godhardt coauthored an article for Law360 on product liability litigation surrounding autonomous vehicles (AVs).

Bullard and Godhardt outline three significant cases and examine two of the primary product liability causes of action maintained against AV defendants: negligence and failure to warn. The authors also noted they have yet to see a true design defect claim progress to the merits.

Further, the authors consider how plaintiffs bringing product liability lawsuits involving AV technology framed their negligence claims against AV manufacturers. They also examine a failure to warn claim that highlights the various ways a plaintiff can attempt to maintain this cause of action against an AV defendant.
