Making Employees Redundant Could Lead to Unfair Dismissal Claims

Labor and employment counsel Emma Vennesson, associate Charlotte Marshall and trainee solicitor Elise Lanteri coauthored an article for HRreview titled “Making Employees Redundant Could Lead to Unfair Dismissal Claims.” They explain how employers can let employees go fairly while reducing the risk of claims of unfair dismissal during redundancies.

The authors note that there is no law that sets out what a fair process should look like, but a body of case law has established certain key steps over time to ensure that a process is fair. The article highlights that the overriding requirement is full consultation with the employees before any decisions are made and outlines what should be discussed as part of the consultation.
