The Next Steps For Biometrics Legislation Across the US

Chicago partner Justin O. Kay and Philadelphia associate Brendan P. McHugh authored “The Next Steps For Biometrics Legislation Across the US” for Law360.

Illinois’ Biometric Information Privacy Act was the earliest state legislation to regulate the collection, use and retention of biometric information. As the use of biometric data has become increasingly prominent, more states have begun turning their attention to its regulation.

Washington recently became the third state to enact such legislation, with similar regulations having been considered (but not enacted) in several states, and biometrics bills still being considered in Alaska, Connecticut, Massachusetts and New Hampshire. Justin and Brendan examine what the Washington legislation entails, as well as details of other proposed legislation, including whether a private right of action accompanies each regulation.
