Long considered a taboo subject, bankruptcy is becoming a reality for many, regardless of industry sector. What does it mean if a vendor or customer files for bankruptcy, and if you are the party in distress, how should you manage your own difficult position? While there is no one way to address these issues, it is important to understand the issues presented by a bankruptcy filing in the context of your client’s business relationships. Topics will include the automatic stay, different chapters of the Code, assumption and rejection of leases and contracts and types of claims. We will also discuss the roles of various parties in a bankruptcy case and certain bankruptcy terminology (so you can sound like an expert to your clients).
