Iowa Renewable Energy Obtains Complete Dismissal of Lawsuit by Tender Offeror Seeking to Compel Transfer

Iowa Renewable Energy (IRE) and IRE’s officers and directors defended against a lawsuit brought by REG Washington, LLC (REG), a subsidiary of Renewable Energy Group, Inc., seeking to compel transfer of membership units as to which REG had made a tender offer. In a novel decision, the Court dismissed the claims with prejudice and held that IRE had the right to refuse to approve the transfers. Our firm, led by partner Terri Combs, represented IRE in defending this case.
