Jen Breuer Quoted in Law360

Chicago partner Jen Breuer was quoted in a Law360 article titled, “As Health Info Proliferates, So Do HIPAA Pitfalls.”

In a world where protected health information (PHI) is virtually everywhere in the digital age, health insurers need to be fully aware of potential privacy breaches and the aggressive punishment that will ensue if these rules are not followed.

Recently, New York insurer Affinity Health Plan was slapped with a $1.2 million fine for allegedly leaving 345,000 patient records on leased photocopiers’ hard drives.

“You really have to be on the ball because PHI is everywhere, and you are responsible for it,” Jen commented.

Cybersecurity is increasingly becoming more paramount as health care relies heavily on digital technology, such as telehealth which is remote-monitoring devices, resulting in more PHI-containing equipment.

Jen concluded, “There’s a big concern with all of this equipment, these devices have all the cool bells and whistles but are also ripe for the hacking.”
