American Family Defeats Breach of Contract Claims

American Family Mutual Insurance Company won on appeal in a putative class action involving breach of contract claims when the 10th Circuit affirmed summary judgment and rejected a motion to certify questions to the Kansas Supreme Court. Our firm represented American Family in the appeal. 

The case is one of a spate of putative class actions nationwide that challenge the right of insurers to depreciate labor costs when calculating the “actual cash value” of insured property.
