Insurer Wins Dismissal of Breach of Insurance Contract Claims in Putative Class Action

Immediately after a Colorado Supreme Court decision disallowed the offset of medical payment coverage against uninsured motorist benefits, the client, a national insurance provider, and other major Colorado auto carriers were sued in putative class action cases for breach of their insurance contracts. 

Our firm’s early fact investigation identified that the named-plaintiff had previously executed a complete release of her claims, which provided the basis for a successful motion to dismiss. Our firm is currently defending the dismissal on appeal.
