University Wins Summary Judgment in Equal Pay Act Case

A university successfully defended against an Equal Pay Act claim brought by a female faculty member alleging she was paid less than other male lecturers.Our firm defended the university.

The court granted summary judgment for the university, agreeing that even if the faculty member performed substantially equal work to her comparators, the pay differential was based on market forces and not because of her sex. The plaintiff's termination claim under Title VII and the Age Discrimination in Employment Act were previously dismissed on the basis of timeliness, and plaintiff's counsel voluntarily gave up on two other claims during the summary judgment briefing.
