Overview

Brian Ruocco is passionate about client service and represents businesses in product liability and mass tort litigation. Brian has developed and managed litigation strategy, argued in federal district courts and the U.S. courts of appeals, taken fact-witness depositions and defended expert depositions.

Representative Matters

  • Defeated two class-certification motions for a logistics company facing billions of dollars in exposure in statewide wage-and-hour disputes.
  • Argued and won a motion to dismiss in federal court for a tax-controversy case. Argued and won appeal, with costs.
  • Won a partial motion to dismiss on preemption grounds for a medical device company facing product liability claims.
  • Served as appellate and major motions attorney for vehicle manufacturer. In that role, drafted motions in limine, oppositions to motions for summary judgment, and motions to exclude expert witnesses for trial teams, as well as developed appellate preservation plans for trial teams.
  • Favorably settled cases for a logistics company, a medical device company and a financial services company.
  • Served on arbitration team defending a software company in an employee-misclassification case.

Prior Experience

Prior to law school, Brian was a special education teacher for three years through the Teach For America program in Milwaukee, Wisconsin, and with a KIPP charter school in Washington, D.C.

After law school, Brian clerked for the Hon. Kevin McNulty on the U.S. District Court for the District of New Jersey and then for the Hon. Ronald Gilman on the U.S. Court of Appeals for the Sixth Circuit. He then spent more than three years as an associate at a litigation boutique, where he focused his practice in class-action litigation and medical device cases.

Personal Interests

Outside the office, Brian enjoys hiking, reading LGBTQ literature and spending time with his two rescue dogs.

Pro Bono

  • Represent a transgender woman from Mexico and a gay man from Guyana seeking asylum in the United States.
  • Testified on behalf of the Colorado LGBT Bar Association against proposed legislation before the Colorado House of Representatives' Committee on State, Veterans, and Military Affairs. The legislation was defeated in committee.
  • Represented an indigent client before the Third Circuit in a case regarding his removal order. He subsequently received a trial on the merits of his claims.
