In that way, she positions those comments for eventual Administrative Procedure Act litigation, to bake into the record the agency's arbitrariness and capriciousness. She has also helped businesses navigate risk regarding current regulations to keep commerce moving.

Representative Experience

Complex Commercial Litigation

• Represented plaintiff-side health care providers and technology manufacturers in trade secret and noncompete litigation matters from complaint through trial preparation.
• Represented directors and officers in a post-bankruptcy civil fraud suit flowing out of a contract dispute from the crypto winter of 2022.
• Defended large medical device manufacturer in civil fraud lawsuit.
• Won dismissal of civil fraud lawsuit against large residential mortgage institution.
• Secured a default judgment after a contested hearing regarding a fraudulent mechanic's lien for a large residential mortgage institution.
• Acted as local counsel for a large banking institution in securing settlements in over 30 matters in mortgage repurchasing disputes in the US District Court for the District of Minnesota.

Administrative Law

• Avoided licensing enforcement for clients under investigation before state boards of medicine, pharmacy, psychology, social work, health, home health care, mental health, commerce, funeral directing, accountancy, revenue and tax, and private detectives and protective agents.
• Won dismissal of New York City Health Code violations for large multinational restaurant chain via the Office of Administrative Hearings and Trials (OATH).
• Defended large mental health care provider in license revocation hearings related to medical necessity and standards of care.
• Secured certifications for two specialized nonprofit organizations that had previously been revoked or denied.
• Achieved 87% success rate (over double the usual 41% rate) for more than 100 overbilling / medical necessity appeals to a CMS recovery audit contractor (RAC) for a medical device company.
• Prepared Administrative Procedures Act matter to overturn agency adjudication for an arms manufacturer.
• Argued at the Minnesota Court of Appeals regarding Minnesota Department of Human Services background study disqualifications.
• Prosecuted sensitive licensing matters for a local tribe.

Internal Investigations & White Collar

• Collaborated with food, health care, energy, and manufacturing clients to internally investigate liabilities pre- and post-enforcement to help guide business solutions towards better compliance with FDA, CMS, SEC, and Sarbanes-Oxley requirements.
• Assisted in the defense of food and health care clients under investigation by the Department of Justice for criminal and False Claims Act liability.
• Represented pharmaceutical companies in criminal liability and restitution (victim) stages of DOJ anti-counterfeiting prosecutions.
• Represented health care entities in billing fraud inquiries by state attorneys general.
