Rollover Recommendations: The DOL Fiduciary Rule Stay and What Remains

Benefits and executive compensation partners Fred Reish and Joshua Waldbeser and counsel Joan Neri co-authored an article for the Journal of Pension Benefits titled, “Rollover Recommendations: The DOL Fiduciary Rule Stay and What Remains.”

The article discusses instances when the current DOL fiduciary rule and current PTE 2020-02, unaffected by the current litigation and stay, might apply to a rollover recommendation by an advisor. Those instances include if there is a preexisting fiduciary relationship with the plan, a preexisting fiduciary relationship with the plan participant and IRA to IRA transfers.
