David Porteous Addresses Unauthorized Use of Messaging Apps With Business Insider

Business Insider reported on how many Wall Street firms are required to supervise employees and review business communications to ensure that no one is being tipped off to potential deals. The publication turned to business litigation partner David Porteous for insight on the issue of monitoring employees.

The lines can be easily blurred, and employees who even unwittingly handle business on WhatsApp, for example, have effectively created unauthorized and unsupervised records and books, said Porteous. “To the extent those communications are benign, it is still a books and records and supervisory systems issue for the firm.”
