Pay Attention to Your PERM Applications

Permanent Labor Certification (PERM) applications continue to face audits and denials by the Department of Labor (DOL). With the increased scrutiny of PERM applications bringing longer processing times, cases must begin earlier and earlier to adhere to H-1B and other deadlines.

Carlson and Kilibarda stressed that employers should begin the PERM process as soon as possible to avoid delays, and should also review the most recent decisions issued by the Board of Alien Labor Certification Appeals (BALCA). Understanding the decisions issued by BALCA can be valuable should the employer decide to appeal a denial by the DOL.
