The filing of the Shipp v. Central States Manufacturing, Inc. complaint challenging the Company's re-leveraging transaction appears to open a new front in the ESOP litigation landscape. In light of the importance of re-leveraging as a tool to ensure ESOP sustainability, this session was designed to educate the audience about the issues raised in the complaint and to discuss processes that can support appropriate application of this tool and discourage unwarranted legal challenges.
